1. Agreement to Terms

By accessing or using Tecdad's services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing our services.

2. Use License

Permission is granted to temporarily access the materials on Tecdad's website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

• Use the materials for any commercial purpose or for any public display
• Attempt to reverse engineer any software contained on Tecdad's website
• Remove any copyright or other proprietary notations from the materials
• Transfer the materials to another person or "mirror" the materials on any other server

3. Services Description

Tecdad provides digital marketing, branding, web design, web development, website maintenance, and video editing services. All services are provided subject to availability and may be modified, suspended, or discontinued at any time without notice.

4. User Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our service. You are responsible for safeguarding the password that you use to access the service and for any activities or actions under your password.

5. Intellectual Property

The service and its original content, features, and functionality are and will remain the exclusive property of Tecdad and its licensors. The service is protected by copyright, trademark, and other laws. Our trademarks may not be used in connection with any product or service without the prior written consent of Tecdad.

6. Client Responsibilities

Clients agree to:

• Provide timely feedback and approvals for all deliverables
• Supply all necessary materials, content, and information required for project completion
• Make timely payments according to the agreed-upon terms
• Ensure that all content provided does not infringe on any third-party rights
• Maintain confidentiality of any login credentials or access information provided

7. Payment Terms

Payment terms will be specified in individual project agreements or service contracts. Unless otherwise stated, payments are due within 30 days of invoice date. Late payments may be subject to interest charges and may result in suspension or termination of services.

8. Refund Policy

Refund policies vary by service and will be outlined in your specific service agreement. Generally, deposits and payments for work already completed are non-refundable. Refund requests must be submitted in writing and will be evaluated on a case-by-case basis.

9. Limitation of Liability

In no event shall Tecdad or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use Tecdad's services, even if Tecdad or a Tecdad authorized representative has been notified orally or in writing of the possibility of such damage.

10. Indemnification

You agree to indemnify, defend, and hold harmless Tecdad and its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses arising from your use of the service or your violation of these Terms.

11. Termination

We may terminate or suspend your account and bar access to the service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms. All provisions of the Terms which by their nature should survive termination shall survive termination.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of New Jersey, United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

The information (Phone Numbers) obtained as part of the SMS consent process will not be shared with third parties for marketing purposes.

If you have consented to receive text messages from Tecdad, you may receive messages related to the following:

• Project updates and milestones
• Appointment reminders
• Follow-up messages
• Billing inquiries

Example: "Hello, this is a friendly reminder of your upcoming web project which is going live on [Date] at [Time]. You can reply STOP to opt out of SMS messaging from TecDad at any time."

Message Frequency

Message frequency may vary depending on the type of communication. You may receive up to 5 SMS messages per week related to your project, billing, or account status.

Potential Fees for SMS Messaging

Please note that standard message and data rates may apply, depending on your carrier's pricing plan. These fees may vary if the message is sent domestically or internationally.

Opt-In Method

You may opt in to receive SMS messages from TecDad in the following ways:

• Verbally, during a conversation
• By submitting an online form

Opt-Out Method

You can opt out of receiving SMS messages at any time. To do so, simply reply "STOP" to any SMS message you receive. Alternatively, you can contact us directly to request removal from our messaging list.
